The General Terms and Conditions as described here apply to every product offered on the FURNIFIED webshop and all deliveries. Any order implies acceptance of the terms and conditions.

The consumer has the right to notify the seller that he renounces the purchase without penalty and without giving any reason within 14 calendar days, from the day following the delivery of the product or the conclusion of the service contract.

The General Terms and Conditions are exclusively subject to Belgian law.

Definition

  • Working days are all calendar days with the exception of Saturdays, Sundays and public holidays.

Purchase and payment

  • The purchaser must be at least 18 years old to be able to place an order in this webshop.
  • The agreement between FURNIFIED and you, the buyer, is established when you have accepted the conditions set by FURNIFIED and complied with them. The absence of a signature does not affect the binding force of the offer and its acceptance.
  • FURNIFIED reserves the right to refuse an order or to subject it to additional conditions, such as for large orders, orders placed by minors, incomplete order procedures or problems with previous orders.
  • FURNIFIED always confirms the purchase by e-mail. If no confirmation email has been sent, the agreement is not yet in force.
  • Payment for products purchased from FURNIFIED will only be made by proposed methods of payment.
  • The seller remains the owner of all goods until full payment has been completed.
  • In order to ensure secure online payment and the safety of your personal data, transaction data is sent over the internet using encrypted SSL technology. You do not need any special software to pay with SSL.
  • Furnified's invoices are payable at its registered office and no later than on its due date. If the payment is not made in due time, the invoice shall, by operation of law and without formal notice, be increased by a negligence interest of 10% and by a fixed compensation equal to 10% of the invoice amount, with a minimum of 100,00 EUR.
    • By non-payment of an invoice on its due date, all other amounts due, even if not yet due, shall become immediately claimable.
    • If a delivery is only partially fulfilled, the corresponding price shall be owed. When making payments, the client may not under any circumstances withhold an amount as a deposit. Such a deduction shall be regarded as late payment.
    • Furnified may suspend its deliveries if the customer fails to fulfill his payment obligation. Complaints shall not result in the suspension of the customer's payment obligations.
  • The General Terms and Conditions and confirmation e-mails are always formatted in the language of the website.

Delivery and delivery times

  • The delivery times stated by FURNIFIED are approximate and are not firm deadlines.
  • If you order a product that is temporarily out of stock, we will indicate when the product will be available again.
  • As soon as the ordered products have been delivered to the specified delivery address, the corresponding risk is transferred to the buyer.
  • Different conditions may apply to deliveries in other countries.
  • FURNIFIED delivers in the following countries: Belgium and the Netherlands. Other countries on request.
  • Delivery shall only be made by a postal service, unless otherwise agreed upon before the conclusion of the contract.
  • The delivery or shipping costs will be communicated to you before you confirm your purchase. If the shipping costs cannot be calculated automatically, this will be stated and/or an indication of the shipping costs will be given.

Product information

  • Information, images, oral statements, tasks etc. relating to all offers and main characteristics of products provided by telephone or via e-mail are given as accurately as possible. FURNIFIED is not liable for any advice it provides, printing errors on the website or technical data provided by suppliers or manufacturers.
  • The availability of each product is indicated. FURNIFIED does everything in its power to ensure that this information is correct, but it can still happen that it is impossible to deliver. This may be due to unintentional errors in stock data or products that are no longer available from suppliers. In these cases FURNIFIED will inform you as quickly as possible and propose a solution.
  • The products offered by FURNIFIED meet the legal standards and may be sold online.
  • It is possible that FURNIFIED includes links on its website to other websites that may be interesting or informative for the visitor. Such links are purely informative. FURNIFIED is not responsible for the content of the website referenced or the use of it.
  • The information provided under the "Frequently Asked Questions" section of our website is part of the General Terms and Conditions.

Withdrawal period (trial period) and returns

  • For all products purchased from FURNIFIED, you have a withdrawal period of 14 calendar days according to the Belgian law on trade practices, consumer information and consumer protection of 12 April 2010.
  • This period commences at the time of receipt by you or on your behalf. During the withdrawal period, we expect you to handle the goods and their packaging with care. There is no right of withdrawal if the product and its packaging are no longer in their original, complete, undamaged and unused condition.
  • If you wish to make use of the right of renunciation, you must do so in writing or by telephone within 14 calendar days from the day following the delivery of the product. There is no penalty associated with cancelling the purchase and this can be done without giving any reasons. More information about cancelling or returning your order can be found in the section cancelling, returning and exchanging on our website.
  • Goods must be returned undamaged, unused and unopened (in their original condition and packaging) at the latest within 14 days of receipt. The date of dispatch shall serve as verification. All enclosed documentation, warranty certificates and packaging materials must be included in the return shipment, as well as your bank account number. Expenses for the return are to be covered by the purchaser. Unstamped or insufficiently stamped shipments are always refused and returned to sender.
  • FURNIFIED will refund the full purchase price (excluding transport costs) within 30 days of receiving the goods.
  • If it turns out that your goods have not been received in accordance with the conditions of the right of renunciation, the purchase price including shipping costs will not be refunded, or not fully refunded. In that case the product remains your property. At your request, the product can also be sent back to you, if you pay the corresponding shipping costs.
    • The following are exceptions to the stated conditions:
      • If a product is specially made or modified for you, you are naturally not entitled to the right of withdrawal of seven working days.
      • If a product has been visibly used or damaged in any other way, your right to a refund lapses.

    • If you choose to collect, the return or exchange must be done in the same way, i.e. at the location where the pick-up was done.
    • The exchange or return of non-conforming or incomplete products or parts can only happen at delivery addresses in BE or NL

Warranty regulations

  • FURNIFIED follows the official warranty guidelines of 2 years. FURNIFIED will bear the cost of the warranty except for shipping costs made by the consumer to bring the product back to us.
    • Fractures or injuries in marble/terrazo or other porous materials are covered by the warranty up to 7 days after delivery. Unfortunately, we cannot offer any warranty for cracks/damage later than 7 days after delivery.
    • Marble/terrazzo is a type of stone that requires careful aftercare; it is recommended to buy a treatment product. You can ask the nearest specialised shop or send us an e-mail for more information on aftercare. Stains or circles caused by not carefully maintaining the stone are the responsibility of the user and are not covered by warranty.

Defects

  • You must carefully inspect your goods or have them inspected immediately after receipt. In doing so, you must determine that the delivered goods comply with the agreement:
    • Were the right goods delivered?
    • Do the delivered goods meet the agreed quality requirements or - if these are not met - the requirements that may be set for normal use?
  • If a visible defect or shortcoming is detected, you must report this to FURNIFIED within 7 working days after delivery.
  • The costs of returning goods that do not comply with the description of the offer shall be paid by FURNIFIED.

Force majeure

  • Force majeure is understood to include all external causes, foreseen or unforeseen, over which FURNIFIED has no influence, but which prevent FURNIFIED from fulfilling its obligations.
  • FURNIFIED shall also have the right to invoke force majeure if the circumstance preventing (further) fulfillment arises after FURNIFIED should have fulfilled its commitment.
  • During force majeure, the delivery and other obligations of FURNIFIED are suspended. If the period in which force majeure prevents FURNIFIED from fulfilling its obligations lasts longer than 8 weeks, both parties shall be entitled to dissolve the agreement without any obligation to compensation.

Pricing

  • You will be informed of the prices of the goods prior to checkout. All prices are expressed in euros and include VAT, Recupel, BEBAT and Reprobel. The shipping costs are indicated separately.
  • If FURNIFIED agrees a certain price with you, FURNIFIED is nonetheless entitled to increase the price.
  • Offers are valid as long as our stock lasts.
  • If a price increase occurs after the conclusion of the contract, you may dissolve the contract regardless of the percentage of the increase.
  • A price offer issued by name has a validity period of 2 weeks, unless a different period is stated in the offer.

Intellectual property rights

  • The contents of this site, including brands, logos, drawings, data, product or company names, texts, images, etc. are protected by intellectual rights and belong to FURNIFIED or entitled third parties.

Questions and complaints

  • Complaints or disputes must be reported within 14 days of delivery. If the complaint is found to be justified, our liability shall be limited to the exchange of the goods. Every liability of the seller is limited to the amount actually paid for the order.
  • FURNIFIED always handles questions and complaints within the reasonable period of 14 calendar days.

Disputes

  • All offers and agreements are subject exclusively to Belgian law, to the exclusion of the principles of legal conflicts above the national level.
  • All disputes related to or arising from offers made by FURNIFIED, or agreements made with FURNIFIED, shall be submitted to the appropriate judge in Antwerp, unless a mandatory provision of the law explicitly designates another judge as competent.

Promotional Contests (via social media or the website)

  • Participation is always possible until the end of the month, unless otherwise stated.
  • Winner will be notified personally and not via social media or the website in order to not violate the winners privacy.
  • The winner will always be informed personally one week after the end of the contest. Furnified does not engage itself to inform all participants about the outcome of the contest.
  • Furnified employees are excluded from the promotional contests.
  • All disputes related to or arising from offers made by FURNIFIED, or agreements made with FURNIFIED, shall be submitted to the appropriate judge in Antwerp, unless a mandatory provision of the law explicitly designates another judge as competent.

Limitations of liability

  • The information on the website is of general nature. The information is not adapted to personal or specific circumstances, and therefore cannot be considered as personal, professional or legal advice to the user.
  • FURNIFIED makes great efforts to ensure that the provided information is complete, correct, accurate and updated. Despite these efforts, errors may occur in the information provided. If the information provided contains errors or if certain information on or via the site is unavailable, FURNIFIED will make every effort to rectify this as soon as possible.
  • FURNIFIED cannot be held liable for direct or indirect damages resulting from the use of information on this site. If you discover errors in the information provided via the site, you can contact the manager of the website.
